It was established under the Companies Act 2013 . These Terms and Conditions, along with Disclaimer and Privacy Policy, govern your relationship with Cakesportal Florist pvt ltd (hereinafter “Cakesportal”. These Terms and Policies are binding on you as a legal equivalent to a signed contract. Cakesportal Florist pvt ltd will be responsible to fulfill your order, including the issue of invoice and delivery to recipient. In no event shall any affiliate, director, representative or officer, nor consultant, be liable for transactions made through this website.

Acceptance of this agreement will be made by your participation as a customer.

The website has the information of products. You are offering to buy when you place an order. We must accept such an offer. Acceptance of your offer does not occur when we acknowledge your order via email, SMS/push notification. 

Cakesportal has the right to reject or cancel your offer, in whole or part, once it receives the order. Cakesportal will accept the offer once it is dispatched to delivery. Cakesportal acceptance of an offer or order is conditioned on Cakesportal non-compliance. Before accepting an order, we may need additional information or verifications. You will need to provide accurate information about the recipient, including their name, contact number, and shipping address in the event of a purchase.

Cakesportal may cancel all or part of your order. You agree to this:

You will receive an Order Confirmation email and SMS shortly after placing an order online. This will contain all details about your order including the order number that will be needed in case you need to contact Cakesportal.

When your order is delivered, you will also receive a Delivery confirmation e-mail.

Cakesportal will deliver the products to the recipient according to the delivery option chosen by the User when placing an order. Delivery times are dependent on the delivery address you provide. Cakesportal offers Three delivery options to customers: Fixed Time Deliveries, Midnight & Standard Delivery. Cakesportal charges a nominal fee to customers who choose fixed-time delivery & Midnight Delivery. These charges are displayed on the webpage when you select the delivery time. Cakesportal Fixed Time Delivery policy requires that your product be delivered within the time frame you choose.

However, Cakesportal cannot guarantee delivery. This is because Cakesportal can not control factors beyond its control (Force Majeure Events).

These include travel delays caused by courier partners or transporters, weather conditions, strikes, lockdown, and other unforeseen circumstances. We will contact you in such instances. For updates, please check your e-mails regularly.

Flowers can be delivered fully bloomed or semi-bloomed. We will attempt delivery once because cakes are perishable. We cannot redirect the delivery to another address.

We recommend that you place your order at the least five days before any major event or festival.

Hand delivered products cannot be shipped with courier products. These products may not reach the recipient in two days or at different times.

  • Orders must be received by Cakesportal prior to 6:00 PM, Monday -Sunday, IST, for same-day standard delivery
  • Orders must be received by Cakesportal prior to 6:30 PM, Monday -Sunday, IST, for same-day delivery.
  • Orders for same-day delivery at midnight must be received by Cakesportal prior to 7:00 PM, Monday – Sunday, IST.

The delivery time requested is not binding. The estimated delivery time will depend on availability and destination.

Delivery could take longer because of:

  1. Weather disasters
  2. Political disturbances
  3. Unexpected circumstances

We will contact you immediately in such instances. For updates, please check your e-mails regularly.

We recommend that you place your orders at least five days before major events.

For products delivered by hand, deliveries are made on Sundays or on Public Holidays.

The order will be cancelled if there is not someone available at the shipping address to take delivery. In such instances, there are no refunds, cancellations or liability. As mentioned above, we will do our best to make sure that you are satisfied.

  • To schedule a delivery time, call the recipient.
  • Leave a note asking the recipient to contact the florist to arrange a delivery.
  • Place the arrangement/bloom in a protected area of your home (porch or garage, or any other entrance).
  • Place the arrangement/bombay with a neighbor, and leave a note on the door of the recipient with this information.

Midnight Deliveries

Delivery will take place on the delivery date chosen, subject to all other terms in the Shipping Disclaimer. Notice: The delivery date must be chosen at least one day before the occasion.

Delivery within a Fixed time

We are unable to guarantee delivery time. The Shipping Disclaimer states that the order will be delivered within 30 minutes or 30 minutes depending on the time selected.

Courier Products Delivery

We will inform you about delivery by courier or on the product selection. Cakesportal makes no representations or warranties regarding the delivery of orders that are placed through courier agencies or third parties, despite the provisions in these Delivery Terms. The Terms and Conditions of the courier company that delivers the products are applicable. The delivery date for products shipped by our courier partners is only an estimate. You may receive your order one day before or two days after the delivery date.

The delivery dates requested for such products are not binding. The estimated delivery date will depend on availability and destination. These deliveries are not possible on Sundays or Public Holidays.

Prior to delivering your order, our courier partners will not call you. We recommend that you give an address where someone can receive it. You cannot redirect the delivery to another address.

All courier orders are carefully packaged and shipped from our warehouse. Once your order is dispatched, you’ll receive a tracking number to help you track it. Sometimes, holidays or strikes can cause delays for courier partners.

Third-party courier agencies are not allowed to deliver on Sundays or Public Holidays.

Delivery to Hospitals Policy

Our Cakesportal florists are skilled in delivering flowers to hospitals. Please include the following information when placing an order

  1. Name of the hospital
  2. The full address of the hospital
  3. Phone number of the hospital
  4. Name of the recipient
  5. Number of the room or ward

Because most hospitals don’t allow florists to deliver to individual rooms, we will ship your order according to facility procedures. Many ICU patients are prohibited from receiving flowers. Before placing any orders, please check the hospital’s guidelines.

Delivery to Hotels Policy

Our florists are skilled at delivering flowers to hotels. Please make sure to include the following information:

  1. Hotel name
  2. The full address of the hotel
  3. Phone number of the recipient as well as the hotel
  4. Name of the recipient
  5. Number of the recipient’s room
  6. If applicable, name of the tour company

The order will not be accepted if the recipient does not check in at the hotel by the delivery date. The order will be considered executed if the recipient has not checked out by the delivery date.

Delivery to Wedding Halls/Marriages Policy

We may not be able guarantee delivery of ordered items to Wedding Ceremonies/ Marriage Halls. We will however ensure delivery to the responsible host.

Delivery to Hostels/PG/Cantonment/Enclosed Premises

Our florists are experienced at making deliveries to hostels/PG/Cantonment/Enclosed Premises. Please make sure to include the following information:

  1. Hostel name
  2. The full address of the hostel
  3. Phone number of the recipient or the hostel
  4. Name of the recipient
  5. Number of the recipient’s room

After coordinating with the delivery person, the recipient must either collect the delivery at the gate or send someone to his/her place. You can hand the order to security or any other responsible person. Otherwise, the order will remain at the reception.

Delivery to Remote Locations and Towns

Only cities that are listed in our Data bank can receive orders. Remote delivery depends on the availability and location of our associate or store. We are unable to guarantee delivery times to remote locations.

Please note that cakes, flowers and other perishable items are sourced locally at the delivery address. It is possible that deliveries of natural plants, flowers and cakes may not be available to such addresses.

National holidays are not considered holiday days. Delivery of the same would take place on the next day. Floods/ heavy rains/ National Bandh/elections/curfews/traffic jams/festivities times/regulated traffic movements, or any other impediments which may hinder delivery of the order. Cakesportal reserves all rights to change the delivery date.

Delivery to airports, Metro stations and railway stations

We don’t deliver to airports, Metro stations or railway stations.

Deemed Delivery

Cakesportal will only attempt delivery once for any order, regardless of its category or class. If delivery is delayed for any reason, Cakesportal will charge you the full amount and there will be no redelivery. The order will be considered as executed in the following cases (Deemed Delivery).

  • Shipping/delivery address incorrect
  • Not available for the recipient
  • Premises locked.
  • Refusal to accept delivery by the recipient

In case the recipient is not available at given address, our delivery boy will try to contact User and User can inform the delivery person to deliver the product to the gate/reception/neighbor of Recipient. We do not contact the recipient in these circumstances as it could surprise them. Cakesportal will not entertain cancellations, refunds, or modifications in these cases. We ask that you verify the availability of the recipient before placing an order.

Cakesportal delivery personnel or representative will ask the recipient for an acknowledgment of delivery upon delivery. If Recipient refuses to accept delivery, or provides acknowledgment of delivery, Cakesportal representative or delivery personnel will request that Receipt send an e-mail to Customer/User. This is a sufficient proof of delivery for any dispute with the customer.

We will be glad to help you if you place two or more identical orders. If the order was not prepared or delivered, we will issue a full refund. We will contact the customer to confirm that we have received the exact same order twice if we discover it. If the customer cannot be reached, we will make the final decision and notify you

You agree to pay the applicable price for the product or service at the time that you submit your order (Product Prices), any delivery fees (Delivery Charges), and any taxes applicable (defined below). Cakesportal will not withhold any taxes, fees, duties or other governmental charges arising out of the purchase of products and services.

Except as stated in the Terms and conditions, all payments are non-refundable. Late fees may be charged at a rate of 1.5% per calendar month or higher under Applicable Law. All collection costs, attorney fees and court costs incurred for the collection of past due amounts will be paid by you.

The company has imposed a “Convenience Fee” to facilitate the purchase of a product and ordering delivery anywhere in India. This includes company’s Internet and system handling fees.

These Convenience fees are related to the Order value.

Delivery of orders is subject to payment in Cakesportal’s account. The order will be cancelled if payment has not been received by Cakesportal. Cakesportal accepts Visa, Master Card and RuPay payments.

You agree that you are not using any Credit card or Debit card fraudulently while making transactions on the website. For such transactions, you agree to give accurate and current information about your card. You will be responsible for any fraudulent use of your card. The responsibility to prove otherwise is solely yours. Cakesportal does not assume responsibility for any transaction that is made without your knowledge and consent.

  • The sender may not have provided the correct address for flowers, plants, fruits, sweets or preserved items.
  • Delivery failures are caused by the recipient not being at home at delivery time at the address given by the sender, or the recipient refusing the delivery.
  • Product quality problems caused by improper handling of the product by the recipient

Cakesportal will issue a full refund in wallet if you cancel your order at least 48 hours prior to the delivery date.

If we are unable or unwilling to deliver all or part of your order (the product, or any substitute product), we will notify you as soon possible and refund your payment for the undeliverable part.

Cakesportal will process your online refund upon receipt of the confirmation by mail or telephone call to the recipient or customer. Cakesportal will process your refund within 10 to 15 business day.

We will not accept any requests for product exchanges.

Refunds are allowed in legitimate cases. If you receive a damaged or incorrect product, please let us know as soon as possible. Within 24 hours of receiving your product, you can email us support@cakesportal.in. A representative will reach out to you, asking for details about the product and any defaults. Your cooperation and support will be greatly appreciated. Courier Products Delivery

We will inform you about delivery by courier or on the product selection. Cakesportal makes no representations or warranties regarding the delivery of orders that are placed through courier agencies or third parties, despite the provisions in these Delivery Terms. The Terms and Conditions of the courier company that delivers the products are applicable. The delivery date for products shipped by our courier partners is only an estimate. You may receive your order one day before or two days after the delivery date.

The delivery dates requested for such products are not binding. The estimated delivery date will depend on availability and destination. These deliveries are not possible on Sundays or Public Holidays.

Prior to delivering your order, our courier partners will not call you. We recommend that you give an address where someone can receive it. You cannot redirect the delivery to another address.

All courier orders are carefully packaged and shipped from our warehouse. Once your order is dispatched, you’ll receive a tracking number to help you track it. Sometimes, holidays or strikes can cause delays for courier partners.

Third-party courier agencies are not allowed to deliver on Sundays or Public Holidays.

If the recipient is not available, we will try delivery again. In the event that the delivery address is wrong or the recipient refuses to accept delivery, delivery shall be considered to have been made. The courier company will try to deliver the package twice before it returns to its original destination.

If delivery is not completed during the attempts, the order will still be charged.

  • No shipping/delivery address.
  • Not available for the recipient
  • Premises locked.
  • Refusal to accept delivery by the recipient

In case if the recipient is not available, he/she can inform the delivery person to deliver the order to the gate/reception/neighbour.

Delivery to Hospitals Policy

Our Cakesportal florists are skilled in delivering flowers to hospitals. Please include the following information when placing an order

  1. Name of the hospital
  2. The full address of the hospital
  3. Phone number of the hospital
  4. Name of the recipient
  5. Number of the room or ward

Because most hospitals don’t allow florists to deliver to individual rooms, we will ship your order according to facility procedures. Many ICU patients are prohibited from receiving flowers. Before placing any orders, please check the hospital’s guidelines.

Delivery to Hotels Policy

Our florists are skilled at delivering flowers to hotels. Please make sure to include the following information:

  1. Hotel name
  2. The full address of the hotel
  3. Phone number of the recipient as well as the hotel
  4. Name of the recipient
  5. Number of the recipient’s room
  6. If applicable, name of the tour company

The order will not be accepted if the recipient does not check in at the hotel by the delivery date. The order will be considered executed if the recipient has not checked out by the delivery date.

Delivery to Wedding Halls/Marriages Policy

We may not be able guarantee delivery of ordered items to Wedding Ceremonies/ Marriage Halls. We will however ensure delivery to the responsible host.

Delivery to Hostels/PG/Cantonment/Enclosed Premises

Our florists are experienced at making deliveries to hostels/PG/Cantonment/Enclosed Premises. Please make sure to include the following information:

  1. Hostel name
  2. The full address of the hostel
  3. Phone number of the recipient or the hostel
  4. Name of the recipient
  5. Number of the recipient’s room

After coordinating with the delivery person, the recipient must either collect the delivery at the gate or send someone to his/her place. You can hand the order to security or any other responsible person. Otherwise, the order will remain at the reception.

Delivery to Remote Locations and Towns

Only cities that are listed in our Data bank can receive orders. Remote delivery depends on the availability and location of our associate or store. We are unable to guarantee delivery times to remote locations.

Please note that cakes, flowers and other perishable items are sourced locally at the delivery address. It is possible that deliveries of natural plants, flowers and cakes may not be available to such addresses.

National holidays are not considered holiday days. Delivery of the same would take place on the next day. Floods/ heavy rains/ National Bandh/elections/curfews/traffic jams/festivities times/regulated traffic movements, or any other impediments which may hinder delivery of the order. Cakesportal reserves all rights to change the delivery date.

Delivery to airports, Metro stations and railway stations

We don’t deliver to airports, Metro stations or railway stations.

Deemed Delivery

Cakesportal will only attempt delivery once for any order, regardless of its category or class. If delivery is delayed for any reason, Cakesportal will charge you the full amount and there will be no redelivery. The order will be considered as executed in the following cases (Deemed Delivery).

  • Shipping/delivery address incorrect
  • Not available for the recipient
  • Premises locked.
  • Refusal to accept delivery by the recipient

In case the recipient is not available at given address, our delivery boy will try to contact User and User can inform the delivery person to deliver the product to the gate/reception/neighbor of Recipient. We do not contact the recipient in these circumstances as it could surprise them. Cakesportal will not entertain cancellations, refunds, or modifications in these cases. We ask that you verify the availability of the recipient before placing an order.

Cakesportal delivery personnel or representative will ask the recipient for an acknowledgment of delivery upon delivery. If Recipient refuses to accept delivery, or provides acknowledgment of delivery, Cakesportal representative or delivery personnel will request that Receipt send an e-mail to Customer/User. This is a sufficient proof of delivery for any dispute with the customer.

We will be glad to help you if you place two or more identical orders. If the order was not prepared or delivered, we will issue a full refund. We will contact the customer to confirm that we have received the exact same order twice if we discover it. If the customer cannot be reached, we will make the final decision and notify you

You agree to pay the applicable price for the product or service at the time that you submit your order (Product Prices), any delivery fees (Delivery Charges), and any taxes applicable (defined below). Cakesportal will not withhold any taxes, fees, duties or other governmental charges arising out of the purchase of products and services.

Except as stated in the Terms and conditions, all payments are non-refundable. Late fees may be charged at a rate of 1.5% per calendar month or higher under Applicable Law. All collection costs, attorney fees and court costs incurred for the collection of past due amounts will be paid by you.

The company has imposed a “Convenience Fee” to facilitate the purchase of a product and ordering delivery anywhere in India. This includes company’s Internet and system handling fees.

These Convenience fees are related to the Order value.

Delivery of orders is subject to payment in Cakesportal’s account. The order will be cancelled if payment has not been received by Cakesportal. Cakesportal accepts Visa, Master Card and RuPay payments.

You agree that you are not using any Credit card or Debit card fraudulently while making transactions on the website. For such transactions, you agree to give accurate and current information about your card. You will be responsible for any fraudulent use of your card. The responsibility to prove otherwise is solely yours. Cakesportal does not assume responsibility for any transaction that is made without your knowledge and consent.

Notice: We will not accept complaints after 48 hours. Non-delivery complaints must be filed within 15 days of delivery. After that, we will not be able register any complaints. We will replace any defective or poor quality product. We may need to have a reverse pick-up done on the product in order to be able to redeliver it.

Only in exceptional cases will the company refund the payment for damaged or defective products. The company will replace the incorrect product or refund the amount if the product is damaged.

Cakesportal cannot be held responsible or guarantee refunds in cases where:

  • The sender may not have provided the correct address for flowers, plants, fruits, sweets or preserved items.
  • Delivery failures are caused by the recipient not being at home at delivery time at the address given by the sender, or the recipient refusing the delivery.
  • Product quality problems caused by improper handling of the product by the recipient

Cakesportal will issue a full refund in wallet if you cancel your order at least 48 hours prior to the delivery date.

If we are unable or unwilling to deliver all or part of your order (the product, or any substitute product), we will notify you as soon possible and refund your payment for the undeliverable part.

Cakesportal will process your online refund upon receipt of the confirmation by mail or telephone call to the recipient or customer. Cakesportal will process your refund within 10 to 15 business day.

We will not accept any requests for product exchanges.

Refunds are allowed in legitimate cases. If you receive a damaged or incorrect product, please let us know as soon as possible. Within 24 hours of receiving your product, you can email us support@cakesportal.in. A representative will reach out to you, asking for details about the product and any defaults. Your cooperation and support will be greatly appreciated.   • Only products that are covered by our warranty terms can be returned. These terms can be found under the product description section of our website. All orders placed via our website www.cakesportal.in are covered by a warranty against manufacturing defects.
  • Warranty is only available for manufacturing defects. It cannot be claimed on defects caused by mishandling or normal wear and tear.

Cakesportal may pursue legal action against any user who is suspected of engaging in fraudulent transactions on the site. This includes the collection costs, the cost of products, and the fees of lawyers. Cakesportal has the right to bring legal action against any User involved in fraudulent transactions on the Site.
